Important Info…It is important that you read these terms and conditions as they set out our obligations to you and your commitments to us when you book with Mojito Ltd. These along with the information detailed in the booking disclaimer and your itinerary form the basis of our contract with you. These terms and conditions apply to all bookings whether you have read them or not and they apply to all members of the group on whose behalf the group leader has booked.

Mojito Ltd accept that every group leader understands and accepts our terms and conditions at point of booking whether the booking is made over the telephone, in person, in writing or via the Internet. It is the group leader’s responsibility to ensure every member of his/her party/group is aware of and adheres to our terms and conditions and supplies all information to the group accurately. Our terms and conditions are available and easily accessible via our website. We also make them available to you via a link on your itinerary & at the time you decide to book with Mojito Ltd. By paying your deposit you acknowledge that you agree to our terms.

Abbreviations …The terms ‘we’, ‘our’ and ‘us’ means Mojito. ‘You’ and ‘group leader’ refers to the person who has made the reservation and each member of the group on whose behalf the group contact has booked (If there is a change in the group leader, we must be notified in writing). ‘Supplier’ means the company or person that is holding or providing the event or any part of it. ‘In writing’ means by email or letter. ‘Price’ means the total cost of the event.  ‘We Travel’ is the payment system that Mojito Events use to collect individual/guest payments.

Contract and Agreement…No contract shall arise between you and us until; A) you have chosen an event which is either advertised on our website or a social media platform or you have been given a tailor-made quotation by email from us that meets with your approval. B) We have received an email or a phone-call confirming your intention to book, the details of the package you wish to book, confirmation of your dates and the approximate number of guests in your group. C) Your accommodation reservation (if applicable) has been accepted and your booking is set up on-line (on We Travel).

Payment of Amounts Due…A non-refundable deposit of £10 per person is due 7 days after your accommodation reservation has been made and your booking is set up on-line.  (Certain package/properties such as party houses may/will require a higher deposit & you will be informed of this at the time of booking).

Any deposits paid are non-refundable in any situation but in most cases, ARE transferable (to a new date for example).  Individuals may be added to your group with the agreed deposit payment per person however Mojito Ltd cannot guarantee that spaces/places will be available, particularly for accommodation. We therefore recommend that you encourage as many people as possible to commit to the deposit payment to guarantee their place.

The balance must be paid no less than 6 weeks prior to your agreed arrival date.  Some properties/packages MAY require for you to pay your balance payment 8 weeks prior to your arrival.  The paid deposit will be deducted from the balance of those people who are confirmed to travel. Those who have paid their deposit but who cannot travel are NOT entitled to a refund at this stage. If you are booking within 6 weeks of the arrival date, you must pay the full cost of your weekend arrangements when you book.  It is the group leaders’ responsibility to ensure this full payment is received on time. If you do not pay us within the time limits specified above this may hinder our ability to provide the event and we have the right to treat all or part of the booking as cancelled.

Any member of the group that has not paid their balance payment in full at this stage will be removed from the booking.  Once you have placed a booking and we have confirmed your details in writing the details will not usually change, providing the arrangements and group size remain the same. Surcharges/supplements will apply where minimum numbers are not reached for certain activities or an event to proceed or if your overall numbers change (if a member of your group cancels from your booking or does not pay their balance on time). You will be made aware of any event or activity that requires a supplement based on changes to your group numbers.  This is in reference in particular to elements of your package that may have a fixed cost (e.g. an exclusive property, limousine hire, private chef or photo-booth).  In the event that an activity cannot take place due to a fall in numbers we reserve the right to cancel your event and refund all monies paid for that event, or we will offer alternative arrangements.  A higher deposit will be requested to cover accommodation deposits for exclusive properties & to cover tickets costs/prices.  Full details of a higher deposit payment will be clear before any booking is accepted.

Mojito Ltd use an online system called WeTravel to collect payments.  This is a professional, regulated, experienced, secure system that allows all guests within your booking to manage their own payments safely & with peace of mind.

 

Special Requirements…If you have any special requests, you must advise us in writing at the time of booking and we will do our utmost to pass any reasonable requests on to the relevant supplier. You should obtain confirmation in writing from us that your request will be complied with (where it is possible for us to give this) if your request is important to you. Unless and until specifically confirmed, all special requests are subject to availability.  Should any additional charge not included in the total price stated on our confirmation letter become payable (for example costs relating to a special request made by you for accommodation), an email will be sent to you showing the extra charge.  Some of our restaurant providers require pre-ordering before you arrive at the venue and it is your responsibility to complete the pre-order and return it by the date specified. Failure to do so may result in your menu being selected for you. Party members with special dietary requirements are asked to contact the restaurant direct to discuss their requirements. Our suppliers reserve the right to change or alter any set menus without notice. Mojito Ltd are not liable for any food allergies and it is your responsibility to make the restaurant aware of any allergies/food intolerances within your group.  You must make our suppliers and us aware of any medical circumstances that may affect your safety or health whilst participating in any activities.

Pricing Policy…All prices and other information advised to you are subject to availability. Prices quoted to you at the time of your enquiry are correct to the best of our knowledge at that time. It is possible that prices may change before you actually book the arrangements. We reserve the right to make changes to and correct errors in prices at any time before your arrangements are confirmed and the booking is made.  Where prices change after you have made your booking, every effort will be made to avoid any price increases however where this is avoidable, the price increases will be passed onto you and detailed in writing.  Please note that if you have amended your travel date for ANY reason, we reserve the right to pass on any increases in cost to you by way of a supplement to your package price.  We will avoid this wherever possible but this may be unavoidable in some circumstances.

Alterations Or Cancellations By You…If you wish to change your booking in any way we will try to comply with your requests but we cannot guarantee that changes can always be made. Where we can assist with your changes, we will not charge an amendment fee. Changes to the date of your booking will incur a £100 administration fee which cannot be avoided however if you decide to change your date due to Government restrictions, we will NOT charge for this date change.  Please be advised though that ALL date changes are subject to availabilityPlease also note that date changes MAY incur additional costs where supplier’s charges have increased for future dates.  You will be charged for any extra costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers (e.g. where deposits have been paid on your behalf to secure a booking or reservation).  Where any cancellation reduces the number of full paying party members below the number on which the price, number of free places and/or any concessions agreed for your booking were based, we will recalculate these items and send you details of the changes via email.

If you wish to cancel all or any part of your booking, you should advise us immediately by email. Charges are based on the estimated expenses, losses we may incur should we be unable to withdraw from our obligations with our suppliers and the service you have received so far.  If you cancel the whole event for ANY  reason you must pay us a cancellation fee. The amount of the cancellation fee is calculated according to the date on which we receive written notice of your wish to cancel. We strongly recommend that you take out independent holiday/travel insurance that MAY cover any cancellations.  If you cancel more than 6 weeks before the event date your cancellation fee normally equals your non-refundable deposit of £10 per person PLUS A CANCELLATION FEE (please see below).   You will also be liable for 100% of the cost of any pre-paid tickets/vouchers or deposits that we have purchased/paid for on your behalf plus any invoices/charges that we are liable to pay on behalf of your group booking that we are unable to cancel.  Pre-paid tickets and vouchers are non-refundable and non-transferable and will remain the property of Mojito Ltd.  No refunds are available for cancellations of a booking or places on a booking less than 6 weeks before your event.  Please also be aware that supplements MAY be incurred due to changes in your final group numbers before/after this 6 week stage.  If supplements are incurred, Mojito Ltd will discuss the supplement due with the lead booker of the event and take their instruction on how this is to be paid (this may be split among existing members of the group, between specific members of a group or allocated to a certain individual/s).  Any refunds agreed will be issued within 7-10 working days (please bear in mind that COVID related refunds may take a little longer).  If you (as the lead booker on an event) are no longer able to attend the event & you need to assign a new lead booker, we will need to receive this in writing (via email).  It is your responsibility to ensure all documentation surrounding your booking is available to the new lead booker.

Cancellation fees…if you are looking to cancel a booking for ANY reason, the following cancellation fees will apply:

Cancellations less than 6 weeks before your travel date ~ Cancellation fee equals the FULL cost of your booking*

Cancellations more than 6 weeks before your travel date ~ Cancellation fee equals your non-refundable deposit, any costs incurred toward your booking (tickets, property deposits, reservation deposits etc) PLUS:

  • £150 per booking of 2-8 guests*
  • £200 per booking of 9-15 guests*
  • £250 per booking for groups of 16+*
  • *Please refer to our ‘Press Pause’ option below to avoid a cancellation fee

Alterations Or Cancellation By Us…If it is necessary to make a small/insignificant alternation to your event, this will not be considered a genuine reason for you to cancel or change the event and you will not be entitled to any compensation.  This may include a change in time, change in venue or change in accommodation provider.  As a company, we will always endeavour to ensure that any small/insignificant changes are like for like.

If a significant change to your event is required we shall inform you immediately and if possible we will offer an alternative activity or event to the same value or allow you to choose an alternative package and refund the difference in cost to you immediately if you have already paid for your weekend in full.  If you are not willing to accept these changes, we will consider the booking to be cancelled by you & standard cancellation policies above will apply. When entering into a booking with us and accepting our terms and conditions you accept that it may prove necessary or advisable for us to vary or modify your itinerary or its contents due to prevailing local conditions.  Wherever possible we will always try and accommodate reduction in numbers incurring no cost to the group. However should the numbers attending be insufficient to run all or part of the event we reserve the right to charge the group for the minimum numbers required for the event.  We will aim to notify you of any changes as soon as possible.

Alterations Beyond Our Control & Extraordinary Circumstances…Under no circumstance are we obliged to cancel, refund or provide compensation if you are affected by unavoidable or extraordinary circumstances in which we or the suppliers of the service in question have no control.  This relates to ANY element of an event/booking cancelled due to, and not limited to,  war and threat of war, riots, terrorist activity, industrial disputes, natural disasters, fire, airport closures (including delayed or cancelled flights), Government-led or Government ordered cancellations (including any Government-related body), biological or chemical disaster, biological or medical pandemic/epidemic, bad weather conditions (including sea, ice & river conditions & flooding) and similar events that are beyond our control or the control of the suppliers involved with your event.  We will however cooperate with you & the suppliers involved to make any necessary arrangements to re-organise your event where appropriate/possible.  Please see our “Press Pause” policy below which may help.

Please note that should pandemic-related restrictions be in place that prevent your event from going ahead that we will offer a FREE date change where possible.  Any deposits that have been paid are non-refundable however, monies can be transferred to a new/future date.  If you choose to cancel your event rather than re-booking a future date, our standard cancellation procedure/conditions will apply.  Alternatively, you can opt for our “Press Pause” policy (please see below).

“Press Pause”…If pandemic-related restrictions mean you cannot travel on your original date/s & you wish to re-book your event, but are not in a position to select your new date just yet, you can avoid losing any monies paid by ‘Pressing Pause”.  Essentially this means putting your booking on hold until you are comfortable to re-book/choose your new date.  Please be aware that all dates are subject to availability & no part-refunds are available for those guests that may have already paid in full.  However, ‘Pressing Pause’ does prevent anyone from losing any deposits & of course avoids a cancellation fee.  Please also be aware that once you do decide on your new travel date, this will be classed as a ‘new booking’ & therefore subject to any price increases associated with your new travel date.  Mojito Events will do ALL we can to avoid any price increases wherever possible but any supplier’s price increases will be passed on to you & a supplement added to your package price accordingly.

Covid-19 Restrictions & Precautions During Your Party Weekend…Mojito Ltd & ALL suppliers that we work with will adhere to Government guidelines regarding Covid-19.  These restrictions MAY affect what you may expect from an activity or venue but these restrictions HAVE to be in place & are for your safety & that of the people around you.  If you fail to adhere to any restrictions &/or do not comply to these, the venue/activity site/accommodation provider have every right to ask you to leave & a refund will not be available.  Please respect all precautions that have been put in place.

  • It is assumed that by maintaining your booking with Mojito Events that you accept ALL responsibility for adhering to ALL CURRENT & EXISTING Government guidelines & restrictions surrounding Covid-19.  Please see relevant Government websites for current guidelines
  • ALL of the venues/suppliers involved with your weekend are committed to providing a safe environment for their staff & for all their guests & it is therefore imperative that as a group of guests, you respect, honour & meet with ALL restrictions or requests that are asked of you during your weekend in order to enable to venue/supplier to also meet with Government guidelines
  • Failure to cooperate with any requests/conditions of your reservation will result in you having to leave the venue/supplier.  Please be aware that NO REFUND will be available should this happen
  • If any of your group are experiencing or have recently experienced Covid-19 symptoms, as per guidelines, it is requested that they DO NOT TRAVEL
  • If you do not meet with current Government guidelines, please contact the team at Mojito Events as a matter of urgency by phone or email
  • In order for us to meet with Government guidelines, please be aware that some details of your weekend may be different to what was originally booked & that certain adjustments may have been made to enable us to maintain your booking in a safe & responsible way.  If you do have any concerns or questions surrounding your itinerary, please contact the office by phone or email
  • Please refer to supplier/venue websites for further information surrounding Covid-19 restrictions (these will be provided on your final itinerary)

Behaviour…We want you to enjoy yourselves as much as possible and understand the fact you have booked a fun weekend. However, as a Mojito client you are expected to behave in a safe and courteous manner at all times. You also agree to ensure that all members of the party act at all times in a safe responsible manner and comply with all safety procedures. We provide a booking agreement document to all our groups and members of your groups are expected to agree to the details on this document.  You must ensure you arrive on time for all events as failure to keep to the timetables may result in either discontinuation of the event or cancellation of the event with no refund. Your group must obey all instructions given to you by activity leaders and dress appropriately for your activities and observe and obey all laws, requests, and conditions of use and other requirements of any supplier. You must also agree to use safety equipment as instructed. You must not tamper with or abuse it.  You are not permitted to arrive at any accommodation or activity suppliers under the influence of alcohol or drugs under any circumstances. Many events and activities require a high level of concentration and the use of alcohol or drugs or being under the influence of alcohol or drugs whilst participating in such events is strictly forbidden. Mojito will not be liable for any refusal of entry or participation in an activity if your group fails to conduct yourselves as detailed in this clause and we will not be liable for any refund, compensation or any costs that may be incurred by you nor will any refunds be given as a result of inappropriate/antisocial behaviour resulting in the event being cancelled.  You also agree to compensate our contractors/suppliers or us for any damage caused by you in the course of an event and damage incurred by any of the participants of an activity or event will be charged directly to the lead person. This will include any intentional damage or damage arising from unreasonable behaviour to suppliers’ equipment, machinery, furnishings (including hotels) and public areas within the facilities booked by you. The management of our suppliers have the right to refuse ongoing services or entry to their premises to any individual whose behaviour is in their sole opinion inappropriate/antisocial.  Some accommodation, event and entertainment suppliers insist on a behavioural bond to be deposited by the group on arrival. Management may refuse your group entry without this bond and Mojito will not be liable for your arrangements if this clause is not adhered to, or if the management refuses entry.

Security Deposits…as Mojito Ltd tend to work with 4* accommodation & above, the MAJORITY of all our accommodation providers WILL request for some form of security/damage deposit.  At the majority of apartments & hotels, this is payable at check in.  With the majority of our exclusive properties, property owners will request this prior to your arrival.  Details of how to pa your security/damage deposit will be outlined on your final itinerary which you will receive approximately 3 weeks before you travel. Please note this is an ADDITIONAL payment on top of any package price/cost.

Security/damage deposits are there for everyone’s peace of mind & are there to protect our accommodation providers against any intentional damage caused during your stay.  Any security deposit request is the policy of the accommodation provider & NOT the policy of Mojito Ltd.  We therefore have no influence over these policies.  We do advise that you make everyone within your group aware that some form of security deposit will be requested.  Security deposits can range from £50 to £750 per apartment (depending on the size of the apartment) & up to £1500 for exclusive properties.  Each property or accommodation provider enforce their own policies so please do ask your event manger if you would like more details in relation to your booking.  Please also note that security/damage deposits are subject to change.

Providing your accommodation has been left in a respectable state (as you found it), that there is no intentional damage and that no excessive cleaning is required, your security/damage deposit will be returned in full following your departure.  If a property owner does go to any cost to repair or replace anything within your accommodation following your stay or goes to ADDITIONAL costs for cleaning etc, these costs will be deducted from your security/damage deposit.  If the cost of repair/damage/cleaning goes above the value of your security deposit, we are obliged to provide your contact details to the accommodation provider to arrange additional payment.

Complaints…If you have a complaint regarding any part of your booking you must notify the supplier at the time. Please give the relevant venue/supplier the opportunity to rectify the situation.  If a complaint/serious issue arises during your weekend you must telephone Mojito Events on the emergency contact number supplied on your itinerary immediately as many issues will be able to be resolved instantly. If you fail to call and report any such incidents or issues, we will not consider ourselves to be liable for those complaints.  Mojito Events will endeavor to rectify any issues where possible.  In a situation where we are unable to provide a solution, a refund will of course be offered to reflect the complaint.  All concerns must also be forwarded in writing to us within 7 days after your event. Please forward your concerns by email to hello@mojitoevents.com.  We will acknowledge receipt of your correspondence and we will respond to all complaints in written format within 28 days.  To ensure all complaints are dealt with professionally & thoroughly, all correspondence must come from the LEAD BOOKER of your event unless otherwise agreed.  If a part-refund is accepted by way of apology and/or to reflect any issues faced during your event, it is assumed this will bring the complaint/matter to a close.

Insurance…You are advised to take out adequate and appropriate personal insurance for your protection. Such insurance should cover the cost of cancellation by you and/or any member of your party and the cost of assistance in the event of illness, accident or if you are prevented from travelling for another reason. You must ensure that the policy you purchase is suitable for your confirmed arrangements including any hazardous activities. Many policies do not cover such activities so you must check the small print before purchasing and if in doubt, check with the insurers that you will be covered. You must also ensure that your insurance covers participation in any hazardous activities which do not form part of your arrangements.  If you decide not to take out travel insurance suitable for your arrangements independently, you hereby agree to indemnify us against any claim or loss or injury, and you and your group members participate entirely at your own risk.  Certain activity providers may insist you sign an insurance indemnity and waiver form; therefore you participate at your own risk, and Mojito shall not be liable for your participation.

 

Health and Safety…It is your responsibility to ensure that you and your group has the appropriate level of fitness to participate in any events or activities you have booked. Many events are not recommended for those with any disability, illness or infirmity. If you or any member of your group have an existing medical conditions, allergies or disabilities which may affect your arrangements you must let us know the details before you make your booking. If in our reasonable opinion, your chosen activity or events are not suitable for that person/persons, taking into account medical condition or disability or they are not being accompanied by someone who can provide all the assistance you may reasonably require we can refuse to accept the booking. If we find out after you have made the booking that you or a group member have an existing medical condition or disability and are not being accompanied by someone who can provide all the assistance you may reasonably require we reserve the right to cancel the booking and impose the cancellation charges where in our reasonable opinion, the confirmed arrangements are not suitable and may cause a risk to yourselves or to other guests. Please note that some of the activities and events we feature are inherently dangerous and by booking these you accept the inherent risks.  Many events and activities require a high level of concentration and the use of alcohol or drugs is strictly forbidden and if you or any member of your party have, at the discretion of our suppliers, been using drink or drugs, they reserve the right to cancel your participation forthwith, and no refunds will be paid.

Weather Conditions & Unavoidable Circumstances…Many outdoor activities and events are dependent upon weather conditions to ensure the safety of all participants. Where any event has to be cancelled due to poor weather, we will do our best to ensure you are advised in advance. If this is not possible you may be advised upon arrival. If this situation does occur and the venue/supplier cancels the event due to health and safety reasons, it is at the discretion of the venue or activity supplier to issue your group with a full refund for that element of your package.  If YOU decide not to take part in any event due to any reasons linked to serious weather conditions, you must notify the venue/supplier direct.  Any refunds will be at the discretion of the supplier or venue. If you/your group are affected by unavoidable or extraordinary circumstances which are without of the control of our suppliers/services, we are not liable to pay any compensation or offer a refund of monies paid.  These events can include war, threat of war, civil strike, terrorist activity, riot, industrial dispute, natural or nuclear disaster, fire, adverse weather or similar events outside our or our, your or the suppliers’ control.  Please refer to our section ‘insurance’ above.

Our Liability…We accept responsibility for ensuring that the arrangements that you book with us are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard. If any part of your package is not provided as promised, we will pay you the appropriate refund. We accept responsibility for the acts and/or omissions of our employees and suppliers except where they lead to death, injury or illness. We do not accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees, suppliers or sub-contractors whilst acting within the scope of, or in the course of their employment in the provision of your booking.  Mojito Events aim to use only reputable suppliers during the process of booking your event.  If an occasion arises whereby a service/product is not supplied according to your itinerary/contract, Mojito Events will endeavor to rectify the situation wherever possible and/or a suitable/alternative arrangement made.  In situations out of our control & whereby an error cannot be rectified for any reason, a refund will of course be offered for that element of your package/event.  Please refer to our complaints section.  Mojito Events cannot be held responsible for for events/situation out of our control for example if a third party unconnected with the provision of the arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with all due care, could not foresee or forestall.

Marketing, Website Descriptions & Special Offers/Packages…All photographs and illustrations on our website are purely representative of the products & events we offer and will be accepted as such. We also reserve the right to discontinue any special offers without notice.  Package names are purely for marketing purposes only & whilst they may represent the details of the package, they are for descriptive purposes only.  Details of a package or special offer may vary over time.  We will always endeavor to provide what has been booked & like for like arrangements to the same value will be arranged.  If we are no longer able to offer a specific activity/element of a package, we will of course advise you.

Any information or details on our website are, the the very best of our knowledge, current & accurate.  We name all our accommodation providers at the booking stage so you are also able to access further information through supplier websites.  Whilst we believe that all our website content is accurate & up to date, this relies on our suppliers keeping us informed of any changes & updates.  Hotels, apartments & party houses often undergo refurbishment or improvement & Mojiot Ltd cannot be held responsible for any changes that may not meet with your tastes or requirements.  Any major changes to properties that we are made aware of will of course be communicated to our customers if/when we are made aware of these.

Competitions, Vouchers & Offers…Any competitions and offers made by Mojito are done so at our discretion.  All details of competitions/offers may be subject to change however we aim to keep all details accurate, as detailed as possible and transparent.  Competition winners will be given a certain amount of time to claim their prize.  All offers are subject to availability and cannot be used in conjunction with any other offer.  Our £75 vouchers cannot be used in conjunction with any other offer (e.g. a Facebook offer/promo).  A £75 voucher can be used on any other website/quoted package on any group of 12 or more guests.  Only one voucher may be used towards a single booking.

General…We believe our Terms and Conditions to be fair. We reserve the right to make amendments and improvements to these terms and conditions without notice & any booking is subject to CURRENT terms & conditions

Data protection and privacy

Please find below our privacy policy which shall be deemed to be incorporated into our terms and conditions. Mojito Ltd takes the privacy of its customers data very seriously. Please read the following policy to understand how we will treat your personal data when you use our site.

When do we collect data?

We can collect data from you from a variety of different sources that include:

  1. When you enquire about our services from our website, from our social media platforms or over the phone
  2. When you create an enquiry/package on our website using our package builder
  3. When you speak to our team in the office
  4. We use Google re-marketing to capture cookie information so we can target visitors who have shown an interest in our services
  5. Personal data collected automatically from your use of the internet and our website. The data transmitted from your browser includes your IP address, the date and time of the visit the pages accessed, the access status/HTTP status code, your browser, your operating system and interface, as well as the language and version of the browser software. The legal basis for collecting and processing this personal data is to be able to operate the sites and provide you with access to the pages you wish to access.

In any of the above cases, the data we collect could be personal data. This personal data includes your name, email address and phone number. Our legal basis for the collection and processing of this data is the provision to you of the services you have requested and may go on to purchase.

What do we do with your personal information?…

Mojito Ltd retains and uses your personal information to provide you with the best experience by providing you with a personalised service and to give you details of offers which we think will be of interest to you. We may also use the information to process any transactions you undertake with us and for internal administration and analysis.

We do not sell, rent or trade your personal information to third parties for marketing purposes without your express consent.

We will ensure that your personal information is kept confidential and secure, and that the appropriate technical and organisational measures, to prevent unlawful or accidental destruction, accidental loss, unauthorised disclosure or access or other unlawful forms of processing, are implemented.
